I'm hoping there are some other union folks on here who can help me understand how workers comp interacts with our union benefits because I'm getting conflicting answers from everyone I ask. I've been a member of the Operating Engineers local out of Highland for about fifteen years, mostly running heavy equipment on road and bridge projects around Ulster County. Back in the winter I was on a site in Kingston when my excavator hit a patch of black ice on a slope and tipped. I jumped clear but landed badly on my leg and ended up with a spiral fracture that needed surgery and a rod placed. I've been out of work since then, collecting my union disability and also getting workers comp, but now the comp carrier is saying that I need to pay back some of the money from the union benefits because of some coordination of benefits rule. I didn't even know that was a thing. I've never been hurt like this before and I thought I was doing everything right by filing both claims. Now I'm getting letters saying I might owe thousands of dollars back and I'm terrified. My union steward told me that coordination of benefits stuff gets complicated fast and that I shouldn't try to sort it out on my own because one wrong move could mess up both my claims. He said I should find a COBA attorney Highland NY who understands how these benefit coordination rules work and can make sure I'm not getting overcharged or having money taken from me that I'm actually entitled to keep. I thought I was in good shape with my union backing me up but this has me completely stressed out. Has anyone else dealt with this coordination of benefits thing between union disability and workers comp? How did it get resolved and did you end up having to pay anything back? I can't afford a surprise bill for thousands of dollars right now, not with how long this recovery is taking.
